Tennesee’s DUI laws may not be tough enough

Most people in Tennessee are responsible and take appropriate caution when driving to keep themselves and others safe. Sadly, however, not everyone does this. Despite decades of public awareness and education, drinking and driving continues to be a problem that plagues the state.

According to the National Highway Traffic Safety Administration, there were 1,317 lives lost at the hands of drunk drivers in Tennessee between 2012 and 2016. Knox County had far and away more drunk driving deaths during these five years than did any of its neighboring counties. In Knox County alone, there were 77 vehicular fatalities in which alcohol was a stated factor.

Of all of Knox County’s neighbors, the county with the next-highest number of drunk driving fatalties was Blount County with 27 deaths. Sevier and Anderson Counties experienced 19 and 17, respectively while in Loudon County another 11 people died. Thirty-four deaths involving alcohol were recorded across Jefferson, Grainger, Union and Roane Counties.

In looking at how many people continue to be killed by impaired drivers, it is reasonable to wonder if Tennessee’s laws on drunk driving are strict enough. According to the Tennessee Department of Safety and Homeland Security, the penalties that a drunk driver may experience can vary based upon multiple factors. Some people may spend as few as two days in jail. Ignition interlock device use and length may not be long enough for some people to change their ways. It is only when a blood alcohol content exceed 0.19 percent that penalties might increase compared to a situation in which a driver’s BAC was below 0.20 percent.

Drugged driver given another chance at probation

Tennessee residents often hear about how strict the state’s laws on drunk or drugged driving are. However, at the same time they also hear about too many cases of an impaired driver seeming to get off without full consequences despite their reckless and negligent behavior.

Sadly, there may be yet another such example as the Supreme Court of Tennessee has recently handed down a ruling that opens up the chance that a drugged driver who killed an innocent woman may not spend time in jail. The case goes back five years when the defendant, operating his pickup truck under the influence of an opioid pain medication, stuck another person who ended up dying as a result of her injuries.

Originally sentenced to spend eight years in prison as part of a plea deal, the defendant lodged a successful appeal and was given a sentence of eight years’ probation instead. In turn, the state took the case to the highest court in the state and now a new sentencing hearing has been ordered. The defendant is an amputee due to a previous crash and this may have contributed to the appeals court’s willingness to grant him probation as he may have had a need to take the medication. For now, family members of the woman who was killed have to wait longer to see what level of justice might be served.

Helmet laws: a safe tactic or violation of freedom?

Any motorbike owner can attest to the pure joys of riding down a highway during perfect weather. In the hopes of attracting more tourists to the state, Republican Senator Kenny Roberts attempted to end the helmet law for insured riders over the age of 21. However, Roberts’ opponents countered his argument by pointing out that determining which riders had insurance would prove difficult for police officers. In addition, the likely increase in brain injuries and other serious accident-related conditions would only make matters worse for state hospitals that often deal with preexisting financial difficulties. 

The Insurance Institute for Highway Safety shows that Tennessee’s universal helmet laws have gone untouched for decades, also acknowledging that antilock brakes and helmets are crucial when it comes to safety. Only Iowa, New Hampshire and Illinois do not require the use of helmets at all. Aside from promoting vital safety practices, many states were motivated by government funding; new laws in 1967 required states to enforce helmet laws in order to qualify for highway construction funds and other roadway developments.
