Tennessee man dies in motorcycle accident

A 27-year-old man has been killed while driving his motorcycle through Red Bank. The man, beloved by his friends and coworkers, has been described as having a big smile on his face wherever he went. A friend also remarked that he could light up any room and displayed a good, loving character in all aspects of his life.

Leaving the kickball game at night, the victim drove his motorcycle along Dayton Boulevard. According to police, the driver of the motorcycle collided with a PT Cruiser that had been exiting a parking lot, and the victim was thrown from the motorcycle. Later in the hospital, the victim was pronounced dead.

After the first collision, the driver of the PT Cruiser hit a pickup truck. There have been no reports of any other injuries as a result of the multi-vehicle crash. Police have launched an investigation to reveal the exact cause of the accident. It is not known if the victim’s family members plan to file a wrongful death claim against the driver of the PT Cruiser.

Failing to yield to a motorcycle before entering a roadway may be considered reckless driving, and, when exiting a parking lot, car drivers are expected to look out for pedestrians and other vehicles. If the investigation reveals that the driver of the PT Cruiser caused the motorcycle accident, the surviving members of the victim’s family may wish to pursue legal action. SUV hit and run kills motorcyclist in Shelbyville

On Aug. 31, a motorcycle rider was killed in Shelbyville after being hit by an SUV. Witnesses say that the 41-year old Bedford County resident was riding his motorcycle down Union Street when he was struck by the black and gold SUV; the driver of the SUV failed to stop at the scene of the accident.

The SUV that was allegedly involved in the accident was later found on Player Drive by a Rutherford County Sheriff’s Deputy. The 1999 Chevrolet Suburban and the Harley Davidson motorcycle were both transported to the Tennessee Bureau of Investigation Lab in Nashville.

The driver of the SUV has yet to be found. Once located, the driver may be taken into custody and charged in criminal court for failing to stop at the scene of an accident. Under Tennessee law, failing to stop at the scene of an accident that resulted in death is a Class E felony punishable by at least one year and up to six years in prison. A driver who negligently causes a car accident may also be sued in civil court by the victim of an accident or the family of the victim killed in an accident. Depending on whether the victim survived the accident, the lawsuit would either be for personal injury damages or for wrongful death.

If a lawyer is representing a client in a wrongful death matter, evidence of the defendant’s conduct may be used in arguing for a larger award in favor of the client. In a hit-and-run case, a lawyer might want to ask a jury to grant a larger amount of compensation against the defendant who failed to stop at the scene of the accident.

New DUI laws in Tennessee

Tennessee Highway Patrol and local law enforcement agencies have taken measures to ensure that drivers suspected of drunk driving will not be able to refuse chemical tests to determine their blood alcohol content. Tennessee authorities conducted a “no refusal” DUI enforcement campaign in several counties during Labor Day weekend, a holiday normally associated with increased automobile accidents.

During Labor Day weekend in 2012, 12 people were killed in 11 fatal car accidents; alcohol was determined to be a factor in two of the deaths. The special enforcement that was put in place for the Labor Day holiday in 2013 included sobriety checkpoints, bar and tavern checks and saturation patrols. The increased enforcement began the evening of Aug. 30 and ran until 11:59 p.m. on Sept. 2.

Many states have criminal laws in place that hold that drivers who refuse to submit to a chemical test such as a blood draw will have their licenses suspended for a period of at least one year, whether or not these people are ultimately found to be guilty of DUI. In some states, officers have already had the ability to forcibly administer chemical tests. The recent enforcement campaign in Tennessee allows officers to forcibly take blood samples only after obtaining a search warrant.

Pedestrian or motorist victims of DUI accidents may seek recovery from DUI offenders in civil court. If a person suspected of a DUI is convicted in criminal court, an attorney dealing with motor vehicle accidents may be able to use evidence of that person’s conviction in a civil proceeding. Now that officers may forcibly obtain BAC readings from DUI offenders, a plaintiff’s attorney may be able to present that evidence in a civil proceeding as additional proof of the defendant’s wrongdoing.

Trial begins for Tennessee driver in fatal hit-and-run accident

Court proceedings have begun in the case of a Tennessee hit-and-run accident. The accused driver on trial is being charged for the collision 18 months after the accident originally occurred in Memphis. The car accident resulted in the death of a local motorcyclist.

The accused driver was brought to court on Sept. 9. Reports claim that the man was operating a business truck without a driver’s license when he struck and killed the passing motorcyclist on Third Street in Memphis in 2012. The motorcyclist was a mechanic and was reportedly en route to work on another vehicle when he was fatally injured in the accident.

The court proceedings came as a surprise to the motorcyclist’s widow as she allegedly learned of the trial 18 months after the incident occurred. She has apparently spoken to news outlets about her forgiveness of the accused driver who fatally injured her husband. The accused is being charged with not having a driver’s license and leaving the scene of an accident involving a death.

While the case remains open as of mid-September, it is unknown of the outcome. Stolen police vehicle linked to fatal car crash in Tennessee

Police in Tennessee said that a woman stole a patrol car and crashed it into a string of other vehicles, killing one person and injuring four more. The fatal automobile accident reportedly occurred as the women hijacked the police car while in the process of being taken into custody. She was charged with vehicular homicide, theft, felony fleeing and violation of probation. Her bond was set at $402,500. Police did not yet know if she was on drugs or drunk at the time of the incident.

The 49-year-old woman was reportedly being arrested in the parking lot of a Dollar General store when she fled in the police car. Authorities said that she then crashed the patrol cruiser into another car, killing a 55-year-old man and injuring four others. The victim was not wearing a seat belt at the time of the wreck, but police said that it wouldn’t have made a difference, considering the force of the crash’s impact.

According to family members, the woman was taken to a local hospital with burns and a broken leg, but her injuries were not life-threatening. They described her as a habitual offender who had done time for theft as well as drug and alcohol charges. Upon the woman’s release, she was arrested and taken to jail, where she would recuperate from her injuries.

Explosion in a TN gas station caused by accident-prone driver

A Clarksville driver who sparked an explosion crashed into a gas station is still causing accidents, according to police. The car accident that occurred at the Clarksville gas station caused one bystander to sustain third-degree burns.

The man and another person were walking through the gas pumps when a car came speeding through the area after it crossed oncoming traffic. It hit a gas pump at the station, causing an explosion that damaged both the building and a parked car. The accident occurred on July 4, and the man with the burns was discharged from a Nashville hospital on July 30. However, this accident was only one of five accidents that the driver has been involved in within about the past year. The most recent accident occurred when the driver said that he had blacked out while he was driving a rented vehicle and crashed into a house. He damaged the garage door and a wall to the house.

Another accident occurred on May 3 when the driver veered across an oncoming lane and crashed into another house. He said that he may have blacked out because of an anxiety attack. On April 7, the driver blacked out and crashed into a ditch. Finally on Aug. 18, 2012, the driver crossed oncoming lanes of traffic and drove through a business’ front yard and hit a utility pole guide wire. Police contacted the Tennessee Department of Safety to ask that the driver be retested in order to keep his driver’s license.

Three cars involved in fatal crash on Knox county highway

Governor John Sevier Highway in Tennessee was the scene of a nighttime accident not far from Austin Park Lane involving three vehicles. Both lanes of traffic had to be closed for longer than five hours as police and rescuers on the scene worked to stabilize the injured and clear the roadway.

The crash occurred when a male driver crossed the center line and ran head on into a SUV traveling in the opposite direction. Upon impact, the SUV spun several times and was thrown into the path of a van, which landed in a nearby ditch. The male driver of the SUV was pronounced dead at the scene and reportedly lived in a neighborhood not too far from the crash site. The passengers in the SUV were a 7-year-old boy who was seriously injured and a 4-year-old girl who suffered only minor injuries.

Three people were riding in the van at the time of impact, and all were transported to UT Medical Center for treatment. Two of the three were seriously injured, and the condition of the third passenger remains unclear. The police report indicated that the driver of the car that crashed into the SUV was also injured and could be facing vehicular homicide charges based on evidence that he was possibly under the influence of drugs or alcohol at the time of the crash.

Tennessee man dies in hit and run accident

A Tennessee man died as a result of his injuries after being hit by a car. According to the report, the fatal car crash occurred after a vehicle allegedly hit the man and sped off. The vehicle was described as a white Lincoln with a red top, which was seen by witnesses leaving the scene of the accident.

Police officers found a woman who was allegedly involved with the accident approximately two miles from the scene of the accident; however, the vehicle in question was not recovered. As of this report, she had not yet received charges in connection to the crime. The victim, who was identified by a family member, was said to be a father and a good man who worked every day.

When a car accident involving a pedestrian occurs, the pedestrian will most likely sustain severe injuries, including neck and back injuries, broken bones and fractures, abrasions and traumatic head injuries. In some cases, the pedestrian may even die as a result of the injuries sustained in the accident. Truck driver behind 2012 fiery crash given probation

A Tennessee truck driver who fell asleep at the wheel of his truck and caused a fiery crash in March 2012 was granted probation on Aug. 19 as part of a plea bargain. The collision seriously injured and nearly killed a Tennessee Highway patrolman.

The officer had just completed a traffic stop on westbound I-40 near the Gallaher View Road when the truck collided with his car. The truck driver was convicted of felony reckless endangerment. He initially faced charges of aggravated assault, reckless endangerment, reckless driving and failure to drive within a single lane of traffic.

The driver of the truck and emergency workers from a passing Rural/Metro ambulance stopped to remove the trooper from his cruiser while flames engulfed the back and passenger side of the vehicle. The police officer was transported to the hospital, where he underwent spinal fusion surgery and remained for several weeks.

The officer, who did not appear in court for the determination of probation, said in a prepared statement that he forgave the driver, saw no point in incarceration and wished the man a “productive life” going forward. The officer further suggested the driver volunteer time to disabled veterans.

There are many possible reasons for truck accidents; a weary truck driver is just one of many. The owner of the truck, the person who loaded the cargo or even a maintenance person may be found to have some fault. Under Tennessee law, any person injured in an automobile accident, not simply the driver, is entitled to compensation for their injuries. Road rage a factor in seven-car accident

According to the Tennessee Highway Patrol, road rage led to a seven-car accident. The crash interfered with the morning commute on Interstate 24. The chain reaction accident began when two men who were involved with each other in a road rage incident, stopped their cars in a travel lane of I-24 West. The two stopped cars, a Honda Civic and a Honda Pilot, caused five other cars to crash into them.

The two men who allegedly began the chain reaction car accident were both cited. One of the men was cited for reckless endangerment, following too close, reckless driving and failure to exercise due care. The other was cited for reckless driving, failure to exercise due care, obstructing the roadway and reckless endangerment. One woman was injured in the accident and was taken by ambulance to a nearby medical center.

The woman who was injured in the multi-car accident may decide to sue the two men for damages.
