Child dies from injuries after rear-end accident

Police officials in Kingsport, Tennessee, say that a 12-year-old boy has died from injuries suffered in a four-vehicle collision on Aug. 27. The boy was the only fatality from the car accident which investigators say happened at about 1:45 p.m. by the Kingsport Pavilion.

According to reports, a 2007 Kia Sedona driven by the boy’s mother, age 46, was heading west by the shopping center when it entered the left turning lane. At that time, the vehicle was hit from behind by a 1995 Chevy Suburban driven by a 62-year-old Bristol woman. The Kia then struck two other vehicles before becoming stuck on a large embankment.

Officers say that the driver of the Suburban made no attempt to slow or stop prior to striking the Kia, which also contained the victim’s younger brother. Both the driver and the second child were transported to the hospital with serious injuries but were later listed in stable condition. The young boy died of his injuries on Aug. 30. The driver of the Suburban has not yet been charged, and she received non-life-threatening injuries as well.

When a family member dies in a traffic accident, remaining family members must often take on the burden of paying medical bills as well as dealing with funeral arrangements and insurance company questions and premiums. In addition to emotional distress, financial problems can have a tremendous effect on those who remain. In some such cases, the family members of a victim may have cause to file a wrongful death lawsuit against the driver deemed to be at fault. An attorney might be able to give reliable legal advice on the viability of such a case.

Tennessee semi truck accident kills 1, injures 3

A truck accident that occurred on Interstate 75 in Campbell County Aug. 27 has left one person dead and three others injured. The accident happened around 3:15 p.m. near Caryville. According to the Tennessee Highway Patrol, a northbound semi-truck crossed over the median and struck a southbound semi-truck head-on.

One of the truck drivers, a 49-year-old man from Russell Springs, Kentucky, was killed in the crash. It is not clear from reports what injuries were suffered by the driver of the second semi-truck. Reports say a passenger car was also involved, and two firefighters were injured. Some of the injured victims were flown to UT Medical Center.

The crash resulted in a chemical fire that closed a portion of I-75 in both directions for several hours and led authorities to evacuate an area within a half-mile of the crash. Witnesses said they heard three or four loud explosions. One of the trucks was carrying batteries, and the other truck was transporting oxidizing materials. However, an earlier report that the crash involved radioactive materials turned out to be incorrect. It is not clear from reports what caused the first truck to cross over the median and strike the second truck.

Motor vehicle crashes can be catastrophic and often result in severe injuries or death. When a person is injured in a truck accident, the injured may be able to seek compensation form a truck’s driver if he or she may have been at fault. That victim may want to consult with an attorney to see if their injuries warrant a civil lawsuit that might allow them to seek compensation for their losses.

Tennessee woman arraigned in relation to crash that killed teen

On August 19, a 33-year-old woman pleaded not guilty to multiple felony and misdemeanor charges stemming from a Rutherford County car accident that killed a teenage boy. She is facing charges of possession of drug paraphernalia, possession of marijuana, vehicular homicide by recklessness, leaving the scene of an accident causing death, reckless assault and vehicular homicide by intoxication. The latter charge is punishable by up to 30 years in prison and a maximum fine of $10,000.

The accident occurred on April 10, when the 33-year-old woman crossed two lanes on westbound Interstate 24 and struck the teenager, who was changing a tire on a vehicle belonging to his mother on the shoulder of the interstate, according to the Tennessee Highway Patrol. Emergency personnel transported the teenager to StoneCrest Medical Center, where he ultimately died of injuries suffered in the crash, authorities reported.

A THP trooper said that the 33-year-old woman evinced signs of intoxication and performed poorly on three field sobriety tests in the aftermath of the event. According to the trooper, the woman said she had taken a prescription medication for attention-deficit hyperactivity disorder and a prescription pain killer. A blood test administered on the woman later revealed the presence of marijuana metabolites, amphetamines and alprazolam in her system, according to the Tennessee Bureau of Investigation.

While criminal cases have no official bearing on civil cases, even when they derive from the same incident and share the same defendant, a wrongful death attorney representing the family of an accident victim may proffer evidence and information adopted from the police investigation if it bolsters the family’s case against the at-fault party. For, certain family members of people who die in a car accident caused by another party’s actionable behavior, such as negligence, may pursue a wrongful death lawsuit in order to recover pecuniary damages related to the sudden death of their loved one.

Trucking company faces federal lawsuit in fatal truck crash

On Aug. 10, a woman filed a claim in a Tennessee court against Yes Express, Inc./”The Blanket Company” and one of the truck company’s drivers whom she says caused an auto accident that killed her 18-year-old daughter and injured two others. The truck driver, who was unhurt, may face criminal charges in the incident.

According to the Tennessee Highway Patrol, the fatal crash occurred on 11W in Rogersville August around 1:23 p.m. when a Texas man operating a 2005 Volvo semitrailer collided with the woman’s northbound 2000 Daewoo after he made an illegal left-hand turn from the roadway’s median. Emergency crews who arrived at the scene transported the two passengers from the Daewoo to local hospitals for treatment of unknown injuries. The Daewoo driver died from major injuries she suffered in the wreck.

In the woman’s lawsuit, she claims that the fatal crash was due to the negligent actions of the truck driver, suggesting that he recklessly and carelessly operated his truck in a way that showed a blatant and willful disregard for the safety of other drivers and their property. Because the plaintiff believes the defendant failed to exercise due care and caused the collision that resulted in the fatal injuries of her daughter, she is requesting the court for an undisclosed amount of economic and non-economic losses stemming from the accident.

When people experience the sudden loss of a loved one in a crash, they might face a number of financial costs associated with the accident. In cases where the decedent had dependents, those who relied on the victim’s income might be negatively affected by the loss of household funds. Through a wrongful death claim, family members of the deceased may be eligible to pursue financial compensation for their accident-related losses, including loss of future contributions of income. In some cases, compensation could include loss of consortium.

3 die in single-vehicle accident

An August 8 accident resulted in the deaths of three people in Anderson County, reportedly. According to the Tennessee Highway Patrol, the crash occurred on Wolf Valley Road at approximately 11:30 p.m.

Authorities stated that a 45-year-old woman was driving a vehicle with two passengers when she attempted to navigate a curve in the roadway to no avail. Consequently, the vehicle left the roadway and flipped over, ejecting all of its occupants, authorities reported.

The two passengers, ages 44 and 25, both died as a result of the incident. The 45-year-old driver was killed as well, officials stated. Purportedly, all three of the vehicle’s occupants were drinking at the time the incident.

As this case illustrates, traffic accidents can have deadly ramifications, even when there is only one vehicle involved. If speed and impairment were in fact contributing factors in this fatal car accident, as law enforcement officials allege, then the event might give rise to civil action. That is because the families of people who die in an auto accident may be eligible to file a wrongful death claim against the party whose negligence contributed to the accident. In the event that the at-fault party died in the accident, the wrongful death claims may be brought against the at-fault party’s estate.

By filing this type of claim, certain bereaved family members may seek compensation for the pecuniary damages that they suffered in relation to the sudden loss of their loved one. For example, they may seek to recover funeral expenses and the costs associated with the decedent’s estate administration. In addition, they may seek lost earnings if their deceased loved one had contributed income to dependents while alive.

Wrong-way driver causes 2-car accident in Tennessee

On Aug. 13, a highway crash caused by a wrong-way driver resulted in three people being sent to the hospital. The car accident also led to several criminal charges being handed to the wrong-way driver. The Tennessee Highway Patrol reportedly charged the 61-year-old woman who was accused of causing the accident with second-offense driving under the influence, reckless endangerment and two counts of reckless aggravated assault.

The car accident happened along Interstate 26 in Kingsport and involved two vehicles. Sometime during the night, a 65-year-old man and his 60-year-old passenger were traveling westbound in a Lexus. When the man noticed the accused wrong-way driver coming towards him in a Chrysler PT Cruiser, he attempted to move into the next lane. The wrong-way driver moved over at the same time, and the vehicles collided near exit 4.

The two occupants of the Lexus and the driver of the PT Cruiser were all transported to Holston Valley Medical Center. Police have reported that all three of their injuries were minor. The Kingsport Fire Department, the Kingsport Life Saving Crew and the Kingsport Police Department all responded to the crash scene. An investigation into the accident continued after the preliminary report from THP.

Many people who are injured in an accident by a wrong-way or drunk driver choose to seek compensation for their injuries. During the process of pursuing a claim, a plaintiff will likely have to face representatives from the at-fault driver’s insurance provider in court. An accident injury attorney might be able to help a victim to pursue the true value of their claim rather than the fractional settlement that many insurance providers will push for.

Tennessee oncologist dies in fatal car crash, man charged

A car accident in Wilson County led to the death of an oncologist on Aug. 5. The crash occurred around 9 p.m. when a man driving on Stewarts Ferry Pike reportedly did not stop at a traffic light and ended up hitting the side of a car that was traveling on South Mt. Juliet Road. The driver who reportedly caused the accident was a 20-year-old man who is now facing multiple charges related to the accident and the fatality.

The younger man’s vehicle struck the driver’s side of the 59-year-old doctor’s car, killing the doctor instantly and causing both vehicles to go off the road into a ditch. There were multiple witnesses to the accident, and at least three people called 911. One witness said that he thought that a man who had his head against the steering wheel was seriously injured.

Another witness relayed seeing the 20-year-old driver get out of his car and stumble. There was evidence that the driver had been drinking alcohol and had taken drugs, according to a traffic report. A blood test was administered, but the results were unavailable three days later. The driver was charged with felony reckless endangerment and received a citation for not yielding to a traffic signal, but authorities are considering a charge of vehicular homicide.

When people lose their lives in auto accidents caused by reckless or negligent drivers, families could look into the possibility of filing wrongful death claims. Attorneys could offer assistance in these cases by working with investigatory agencies to assess the circumstances of the crashes and discuss legal strategies to negotiate for fair compensation.

Tennessee wreck claims life of woman

An Aug. 5 accident claimed the life of a Tennessee woman on U.S. 11W. Two others were also injured in the crash, which occurred when a tractor-trailer attempted to make an illegal left turn onto Sneedville Pike. The driver of the tractor-trailer was not hurt.

According to the Tennessee Highway Patrol, the wreck occurred just after 1:20 p.m. in Rogersville. The woman was driving a 2000 Daewoo north in the left lane of the highway when the semi-truck turned in front of her car. Officers say she was wearing a seat belt but that the safety restraint would not have changed the outcome of the crash. Two passengers in her car, including an infant, were injured. Emergency personnel had to extract the woman from the vehicle.

The 18-year-old woman was declared dead at the crash scene. U.S. 11W was shut down for several hours so that authorities could conduct an investigation into the accident. A trooper stated that the semi-truck driver could be facing charges in connection to the wreck. Since a commercial vehicle was involved, THP was called to investigate, according to officers from the Rogersville Police Department. At least 10 troopers also participated in the crash investigation.

A family of a deceased accident victim may consider pursuing a claim for wrongful death against the driver found to be at fault for a wreck. The compensation a family may be eligible for could help set off sudden expenses related to the death of their loved one such as funeral arrangements and medical bills. In cases where the liable motorist was employed by a trucking company, that company could also be held liable for damages. A lawyer might work with the involved parties in order to negotiate a settlement.

Multi-vehicle crash claims 1 life, injures another

Tennessee authorities report that an accident in Bartlett on Aug. 4 claimed the life of a female teenager who was a passenger in a truck. Media sources noted that the deceased teen was a former resident of the area and was visiting from Houston, Texas.

According to reports, the accident happened at the intersection of Memphis-Arlington and Yale at approximately 4:40 p.m. when a motorist driving a Lincoln Town Car did not yield the right-of-way and hit a Ford F-150 truck. The force of the impact sent the truck across the roadway’s median and into the path of oncoming traffic. A third vehicle then hit the Ford, and the truck rolled over on its right side.

A female teen passenger was ejected from the truck and died as a result. The truck driver, also a teenager, suffered undisclosed injuries, and he was taken to a local medical center. His current condition was not mentioned. Reports did not indicate if anyone else suffered injuries. Police are continuing to investigate the cause of the crash and have not yet pressed any charges.

The unexpected loss of a loved one in a crash could cause a family financial hardships as they deal with final arrangements. Whenever a fatal accident is caused by a negligent or reckless driver, the family of the decedent could hold that motorist liable by filing a claim for wrongful death. Any charges the driver faces may be used to establish negligence in civil court. A victim’s family could be awarded financial compensation for their accident-related expenses and losses such as funeral and medical costs.

1 dead, 1 injured in Tennessee crash

A collision between a passenger vehicle and a motorcycle left one dead and one injured in Greenville on July 26. The driver of the passenger vehicle was arrested after the fatal accident, and she told police that she had not seen the motorcycle as she pulled into the road.

The Greenville Police Department reports that the accident took place about 7:20 p.m. at the intersection of West Summer Street and North Sunset Street when a motorcycle driven by a 52-year-old Kingsport man collided with a Chevrolet van driven by a 25-year-old Greenville woman. The Chevrolet was making a left turn onto Summer Street from a stop sign when it traveled into the path of the eastbound motorcycle.

The driver of the motorcycle and his 54-year-old female passenger were both thrown from the bike due to the impact. The man was declared dead at the scene. His passenger suffered serious injuries, including head injuries and a broken leg. She was transported via air to Johnson City Medical Center.

Police arrested the driver of the Chevrolet after the incident for failure to yield, driving with a suspended driver’s license and violation of financial responsibility. If there is a claim of wrongful death filed related to the crash, the charges might be used as evidence to show liability and negligence.

After a fatal motorcycle crash caused by a negligent driver, the family of the decedent might file a wrongful death claim seeking damages in connection with their loss. A successful claim might allow the family to collect funds for the funeral and burial expenses as well as for the loss of any income that the deceased earned to support dependents. Most civil claims are resolved through out-of-court settlements, for which there may be extensive negotiations.
