Tennessee helmet law changes may increase risk of injuries

As the weather warms up, Tennessee motorcyclists might choose to ride their motorcycles more often. However, as motorcycle use increases, Tennessee doctors also see a rise in serious motorcycle accidents and injuries. This is not unusual; medical staff at the Vanderbilt University Medical Center in Nashville report that warm weather typically results in a 50 percent increase in patients with major injuries, including motorcycle injuries.

With the number of injured motorcyclists already high, VUMC’s trauma surgeons reported that they were concerned over potential changes to the state’s helmet laws. The law changes would make wearing helmets optional for all riders who are over the age of 21. In states that have already made changes to their helmet laws, such as neighboring Kentucky, the rate of motorcycle fatalities has risen. In Kentucky, the fatality rate rose by more than 50 percent, with 53 of the 79 motorcyclists killed in 2013 not wearing helmets. In 2010, the National Highway Traffic Safety Administration reported that Tennessee’s helmet laws saved the lives of 46 people.

One of the VUMC doctors also mentioned that helmet laws reduce the cost of medical care for taxpayers by reducing the risk of life-changing injuries. Additionally, the NHTSA estimated that helmet laws reduce the risk of death by approximately 37 percent and reduce the risk of brain trauma by about 65 percent. This potentially saves tax payers about $3 billion every year.

Often, a motorist may not see a motorcycle, or they may misjudge the distance when making a turn, causing a crash. An attorney could help an injured motorcyclist file a personal injury lawsuit against the other motorist if the plaintiff was following the state’s helmet laws and not driving recklessly or negligently. A successful claim can help a victim recover compensation for the motorcycle accident injuries and other damages they incurred.

2 die in accident on Interstate 40

Two individuals were killed and one was seriously injured during an early morning wreck that happened on Interstate 40 East in Tennessee. According to authorities, the driver of a Dodge Neon stated that he pulled over on the shoulder of the interstate to rest, despite having four passengers inside. After the driver supposedly fell asleep, the car was struck by a van. A third vehicle was then unable to avoid striking the van.

Two of the passengers in the parked car were killed immediately, and a third passenger was taken to Vanderbilt University Medical Center with serious injuries. The driver and fourth passenger were taken to the hospital with less severe injuries.

The driver of the parked Neon stated he was pulled all the way over on the shoulder of the interstate and had his flashers on. However, the other drivers involved in the accident stated the car was parked in the left lane of the interstate, and his flashers were not on. Authorities investigating the scene reported that their initial findings indicated the car was not parked on the shoulder.

Emergency personnel had to close the eastbound lanes, which resulted in cars sitting on the interstate for several hours while the accident scene was cleared. Many motorists were forced to take alternative routes to reach their destinations.

Negligent drivers who do not use care and caution while operating a vehicle may be responsible for those injured as a result of their reckless behavior. Injured parties may be entitled to compensation for medical bills, lost wages and any other financial loss incurred due to the accident. Seeking legal advice may be beneficial in understanding all options available under the law.

Preventing truck accidents in Tennessee

Large commercial vehicles are a familiar sight on the roads of Tennessee, and drivers would be wise to remain vigilant and exercise caution in their presence. Semi-tractor trailers are large and heavy, and catastrophic injuries often result when they are involved in an accident. Some of these accidents could be avoided if passenger vehicle drivers were more patient, but many others are caused by poorly maintained trucks or negligent truck drivers.

Many motorists fail to consider that semi-tractor trailer drivers are operating cumbersome vehicles with limited handling and performance characteristics, and they often do not appreciate the limited visibility provided by a truck’s mirrors. Many truck accidents happen because the semi driver does not see a passenger vehicle that is following too closely, and others are caused by passenger vehicle drivers who make unexpected maneuvers or misjudge a truck’s speed. Another cause of crashes involving trucks is the wind turbulence these vehicles create, which can buffet cars or SUVs unexpectedly as they attempt to pass.

While the majority of commercial vehicle drivers are highly proficient, they often operate under great pressure to complete their journeys as quickly as possible. Driver fatigue is a real problem for logistics companies, and a semi-tractor trailer with a drowsy driver at the wheel is an accident waiting to happen. Large trucks also contain highly sophisticated pneumatic systems, and inadequate maintenance could lead to catastrophic brake or steering failure without warning.

Those injured in accidents involving semi-tractor trailers may pursue civil remedies when negligence is a factor, and a personal injury attorney may file a lawsuit on their behalf against the truck driver, the trucking company or both. A truck driver may be considered to have acted negligently when an accident is caused by recklessness, fatigue or impairment, and a trucking company may be held responsible for accidents caused by lax maintenance practices or insufficient driver training.

New research on distracted teen drivers

Tennessee residents might be interested in hearing about new research that was done on teenage driving behavior. According to the results of a study that was led by an assistant professor at Oregon State University, many teenagers engage in activities that are very distracting while they are behind the wheel. Among those that were surveyed, 27 percent admitted to sometimes changing their shoes and clothes while they drive. Other teens said that they change their contact lenses, do homework or apply makeup while driving.

The lead researcher in the study said that he was surprised by the number of teens who change their clothes while they drive. Though there have been successful campaigns to draw awareness to the dangers of texting while driving, he said that teens should be aware that other distractions can be just as risky. Activities like changing radio stations, configuring GPS settings and even eating can be very dangerous while driving.

The study found that about 40 percent of teens still regularly send and receive texts while they drive. As the number represents a decrease from the results of earlier studies, researchers say awareness campaigns seem to be working. Researchers also found that short drivers education courses were effective in making teens aware of the dangers of driving distractions.

A person who has been injured by a distracted driver has the right to file a personal injury complaint to seek financial compensation. An attorney can help a victim of a motor vehicle accident to build a strong claim against the at-fault driver. Evidence that may help to establish liability could include eyewitness testimony establishing that the driver was willingly engaged in negligent behavior that took away from concentrating on the road.

Multiple injuries reported in Tennessee car crash

Police say that a drunk driver may have been to blame for a crash that took place on March 11 at around 11:18 p.m. The crash occurred at the intersection of State Highway 297 and Little Elk Creek Road in Elk Valley. According to authorities, a Jeep being driven by a 33-year-old man tried to turn onto State Highway 297 while traveling south on Little Creek Road.

A Dodge Ram being driven by a 54-year-old man did not yield the right of way to the Jeep, and the two vehicles collided head on. Both drivers were injured in the crash while a 33-year-old was killed in the crash. It was not clear in which vehicle the crash victim was riding when the collision occurred. Police say that neither the injured drivers nor the deceased were wearing seatbelts at the time of the accident. Criminal charges are pending according to authorities.

Pedestrians, drivers or passengers who are hurt in a car accident may be able to obtain compensation from the driver who caused the crash. Furthermore, the families of those who are killed in a car accident may be able to collect compensation for their wrongful deaths. A personal injury lawyer may be able to take a look at the case and represent injured victims or the families of crash victims who are killed in car accidents.

Injured victims may be able to obtain compensation for lost wages and their medical bills. Long-term medical expenses may also be covered as part of a financial award. Families of deceased accident victims may recover money in the form of punitive damages as well as compensation for lost earnings due to wrongful death. A financial award may be won either in court or through a settlement out of court.

1 dead, 1 injured in truck collision in Tennessee

In Tennessee, one man is dead following a collision involving a pickup truck and a commercial delivery truck on March 6. According to media sources, the deadly crash took place in Lincoln County on Highway 50 near Louse Creek Road. At press time, it was not known if any charges are expected to be filed in the case. However, the preliminary report indicates that weather is not a factor.

The fatal wreck occurred at approximately 9 a.m. in the community of Mulberry when the two vehicles reportedly swerved to avoid each other. Investigators with the Tennessee Highway Patrol say that the semi ran over the top of the smaller pickup, killing its 46-year-old driver and injuring the driver of the commercial vehicle. According to authorities, the deceased driver was not wearing a seatbelt at the time of the incident.

Details concerning the cause of this accident have not been released. However, Tennessee motorists who find themselves injured in a car accident may discover that insurance companies involved in the case may minimize losses, downplay claims for compensation and treat victims as adversaries even when another party is determined to be at-fault. Because it can be difficult to negotiate with insurance adjusters in the aftermath of an accident involving injury or death, those affected may find it beneficial to contact an attorney for help.

The attorney could examine the case evidence, establish liability and determine the total extent of the loss, which could include medical and rehabilitation costs, loss of wages, and pain and suffering. The attorney could also prepare a claim seeking financial compensation from the insurance companies on a client’s behalf and pursue damages in civil court in the event that insurers are unwilling to agree to a fair settlement.

Internal bleeding after car accidents

High-speed car collisions occur daily in Tennessee and throughout the country. Many of those involved in these accidents become victims of blunt force trauma and internal bleeding. Severe internal bleeding can be fatal unless the victim gets immediate medical treatment or surgery.

Whenever people experience a blunt force trauma such as in a car crash, the impact may damage their blood vessels or organs, causing bleeding. The severity of the bleeding depends on the force of the impact. For example, accident victims ejected from a vehicle could suffer damage to their heart, liver, head, major blood vessels and around their lungs, which can produce serious internal bleeding. In other cases of blunt force trauma, victims may incur broken bones or simply deep bruising. Some blunt force trauma victims experience internal bleeding a few days or hours following the incident. In some cases, however, the bleeding stops on its own.

Victims of blunt force trauma can tell they are bleeding internally if they have certain symptoms that become worse. Some of those symptoms are ecchymosis, or patches of skin that turns deep purple or stomach swelling and pain. Headaches could signal bleeding of the brain, while fainting spells, dizziness or light-headedness might indicate that a person is internally losing large quantities of blood.

While many car accident victims die because of blunt force trauma, others may require surgery, long hospital stays and extensive therapy. Because severe blunt trauma is common among those involved in high-speed collisions, it may be possible for the injured party to recover damages if it can be shown that the accident was caused by the negligence of another driver. An attorney can examine police reports and other evidence to support a personal injury lawsuit on behalf of an injured client.

Dump truck causes a 4-car crash

A multi-car pile-up at an intersection in Tennessee occurred on March 2. A dump truck was the cause of the crash, which killed one person and hurt two others. The incident occurred at around 12 p.m., and reports say that the crash resulted in road closures for a time. Traffic was restricted along Memorial Boulevard between the post office at Irongate and Heritage Park until 4 p.m.

According to one source, the dump truck rear-ended a pickup truck, which then rear-ended the car in front of it, and that car hit a car in another lane. The dump truck driver was not injured, and the drivers of the other cars were not seriously hurt. However, the driver of the pickup truck died at the hospital.

The construction company that owns the dump truck had no comment on the accident. However, one media outlet spoke with a woman who described the sound of the incident. According to the woman, the truck accident caused a crash so loud that it could have been massive rocks falling to the ground or bombs exploding.

Semi-truck accidents can cause major damage since they are large vehicles by necessity. Their size coupled with driver fatigue or negligence can cause serious damage, injuries and death. A lawyer may be able to help an individual injured in an accident due to a truck driver’s negligence. If a family member is killed in a truck accident, an attorney may be able to work with the family of the deceased. An attorney may be able get the damages owed to the victim or their family such as medical bills, lost work time, pain and suffering and damage to the vehicle.

Tennessee truck crash results in fatality

A multi-vehicle crash near the Murfreesboro Airport in Rutherford County claimed the life of one person and injured two others on March 2. Tennessee authorities said the accident took place shortly after noon.

According to police, the chain-reaction crash began when a dump truck smashed into the back of a pickup truck that was stopped at the intersection of Memorial Boulevard and Airport Road. The pickup then struck the car in front of it, causing that car to collide with a vehicle in another lane. The male pickup truck driver was airlifted to a local hospital where he later succumbed to his injuries. Two other drivers suffered minor injuries in the crash. The dump truck driver, who works for Melton Construction Company, was not hurt.

Witnesses said the collision sounded like a bomb going off. Memorial Boulevard was shut down for several hours from Heritage Park to Irongate as police investigated and cleared the scene. It was reopened at approximately 4 p.m. The accident remains under investigation.

When a commercial truck driver crashes into the rear of a vehicle that is already stopped, it is often due to driver distraction or driver fatigue. When someone is killed in a similar truck accident, family members may have the right to pursue a wrongful death lawsuit against the negligent driver and in some cases the company that employs that driver. With the aid of an attorney, a victim’s family could use accident investigation reports, witness testimony and other crash scene evidence to attempt to prove that the driver was responsible for the death of their loved one. A wrongful death claim could provide the victim’s family with much-needed financial compensation to cover the unexpected costs of medical care, funeral and burial costs, lost income and other damages.

Tennessee woman dies when semi truck hits her car

The Tennessee Highway Patrol reported the death of a 44-year-old woman in a car and semi truck crash on Interstate 24 between Manchester and Monteagle. The semi hit the back of her 2000 Saturn coupe when her vehicle slowed down. The impact forced her car off the road. Her 20-year-old male passenger was injured.

The report from the highway patrol stated that the woman had seen a disabled car in the median, and that she slowed to stop and offer help. At that point, the driver of the semi, a 48-year-old man, said that he was unable to stop and therefore hit her vehicle.

The truck driver was not hurt. The highway patrol troopers did not attribute the accident to drinking or drugs. Criminal charges, however, remain a possibility once their investigation is finished.

Although it is not known if charges will be pressed against the truck driver, accidents similar to this are sometimes blamed on inattentive driving due to texting or driver fatigue. The survivor of a lost loved one sometimes has cause for filing a wrongful death claim to recover damages like funeral expenses, lost income to a household or medical bills prior to the death. If a car accident resulted from a driver’s negligence, then compensation might be obtained from the responsible party or his or her insurance company. An attorney might be able to assess an accident investigation to see if it contains evidence that indicates negligence. The adequacy of a settlement offered by an insurance company could also be reviewed by an attorney to see if it fulfills a client’s need for compensation.
